Terms an Conditions (Gym Rules)

Please note that these Gym Rules form part of your Membership Agreement. Rules specific to the gym may be displayed on notices or at reception. They form part of the gym rules and may be changed without notice. Breach of these Gym Rules may result in termination or suspension of your Membership Agreement. If your Membership Agreement is terminated as a result of your breach of these Gym Rules, you may also be prevented from re-joining 4U Fitness in the future.

FREE 3 DAY PASS

This trial entitles the bearer to three consecutive days at 4U Fitness. Trial is non-transferrable, not available in conjunction with any other offer and is not exchangeable for cash. Additional fees apply for Personal Training. Not available to existing members, ex members who have terminated their membership within the last three months or individuals who have had a trial in the last three months. Available to New Zealand residents only. Standard 4U Fitness conditions and gym rules apply. 4U Fitness reserves the right to refuse entry on the grounds of minimum age (18), health and safety. Photo ID required. Must be redeemed within 30 days of registration.

HEALTH AND SAFETY

●  You must follow Health and Safety instructions and requests from 4U Fitness staff at all times, otherwise you will be asked to leave the premises

●  Wear gear that’s appropriate and comfortable to exercise in – no jeans, bare chests or bikinis. Please don’t wear anything offensive or intimidating to others●  Wear appropriate sports footwear. No open-toe footwear

●  Please keep bags off the gym floor. Leave all your gear in the lockers provided

●  Towels are compulsory in workout areas. If you’ve forgotten your towel, you can buy one at reception

●  You are expected to clean up after yourself and wipe down all equipment after use

●  Please don’t come here under the influence of drugs or alcohol. Anyone who does will be asked to leave immediately and may have their membership terminated

●  You are not permitted to train or coach others in the gym, whether there is any form of payment or not

YOUR PERSONAL BELONGINGS

●  It’s up to you to keep your belongings safe

●  Please leave your gear in the lockers and use a padlock. Take your gear home every night as lockers are cleared every night

PHOTOGRAPHY IN GYM

●  Don’t photograph or video anyone on gym premises without the express prior consent of every single person who may be in the images, whether staff, PTs or members

●  Don’t post online, broadcast, stream or publish any photo which contains an image of any person other than you or someone who has given you permission to post this image

●  If members or guests want to use any photo or video taken on gym premises for commercial purposes, they must inform the gym manager.

●  4U Fitness staff and contractors may take photos or video recordings for the purposes of providing services to members. Where 4U Fitness staff or contractors take such photos or recordings, they must abide by all relevant 4U Fitness policies including our Privacy Policy and Media & Social Media Policy.

●  Strictly no photos or videos in the changing rooms

THE HEAVY STUFF

●  Don’t bring illegal or banned performance-enhancing substances of any kind on or around gym premises

●  Don’t carry out (or attempt to carry out) any illegal activity in or near our gym

●  Don’t behave inappropriately or offensively, particularly in the changing rooms

●  Don’t use abusive language or harass, insult or threaten anyone (staff or members). We will terminate the membership of anyone who causes other members or staff genuine concern about their safety inside or outside the gym (that includes emails, texts, phone calls or correspondence)

●  Don’t solicit members or carry out any business within the gym. This includes contacting members or staff by email for business purposes without their consent

●  Don’t promote products or services of any kind on 4U Fitness property without the permission of the gym manager

CHILDREN

●  Minimum age for membership is 18

●  Children under 18 require consent from a legal guardian to become a member or use the club facilities on a casual basis.

●  Children aged 14 may use the Club facilities to train with a 4U Fitness Personal Trainer or to participate in 4U Fitness supervised children's exercise programmes, in each case subject to the conditions below.

• the child must have consent from a legal guardian;

• the child's legal guardian is required to be present at the gym during all training sessions and must supervise the child at all times

• a casual membership fee will apply.

• Children under 14 years of age are not permitted in the gym facilities other than where participating in 4U Fitness supervised children's exercise programme.

PRIVACY POLICY

At 4U Fitness, we acknowledge and respect the privacy of individuals. This policy describes how we collect, use, manage and protect your personal information. We are bound by the Privacy Act 1993 and, in particular, the Information Privacy Principles that are set out in the Privacy Act 1993. This Privacy Policy is subject to change. Changes will be posted on our Website and will be effective from the time the information is posted.

WHAT INFORMATION DO WE COLLECT AND HOLD?

We may collect and hold personal information provided by you when you open an account and purchase a membership to use our services, and when you use our services. This information could be from you giving it to us directly, through our Website, www.4ufitness.co.nz or by using an APP made available to you as a member. We use the information to conduct our business and to precisely deliver services and information to you, to assist you with matters relating to the services we provide to you and other members of the studio, to personalise the user experience, improve our Website, process payments, to improve and better understand your preferences, to run a promotion, contest, survey or other feature, to send periodic emails, to notify you of any change to our services or your membership terms (including fees), and to fulfil our legal and regulatory obligations.

WE USE YOUR INFORMATION?

We collect and process personal information about visitors to our Website, clients, customers and users of/visitors to our sites. We do this to deliver services to you, deliver merchandise to you when you make a purchase, process payments that you make to 4U Fitness and learn how to offer you a better product. We may collect and use your personal information for the following purposes, all of which is for our legitimate interest in delivering services and products to you. It is necessary for our contract's performance: This information is usually collected directly from you. From time to time, where it is unreasonable or impractical to do so, information may be collected from third-party service providers or publicly available sources. You may choose not to provide any personal information to us. However, as a result, we may not be able to provide services to you or inform you of changes to the services we provide or to your membership terms (including fees).

USE AND DISCLOSURE OF INFORMATION

We may use the personal information you submit to us to connect with the information contained on this page and direct marketing purposes (including club newsletters). You can opt-out of receiving marketing materials by unsubscribing in one of our marketing emails. Unsubscribe methods are consistent with NZ law. We may disclose personal information to third parties, however, only to meet the purpose for which it was submitted (for example, to process your membership application), to validate the information you provide to us in the course of signing up to and using our services, to undertake fee collection services on our behalf, if we are required or authorised by law to disclose the information, if your personal information is collected in connection with a joint promoter, to that joint promoter for marketing and research purposes; and to protect the personal safety of our staff, other users of our services or the public. MARKETING MATERIAL & SOCIAL MEDIA

We regularly take photos & videos of our members in action for marketing & advertising purposes. By signing our Membership waiver you consent to the use of photos and videos of yourself for marketing and advertising purposes as well as release 4U Fitness and its employees from any liability which may arise from the use of such material used on social media and marketing platforms.
